Carpark
The carpark is accessed by using the garage door opener to open the entrance on Queens Lane behind the building.
All carparks are parts of individually owned lots, but cars need to pass over the common property to reach their carpark.
There are no visitors carparks available on City Condos common property; instead, visitors need to use street parking or parking in one of the nearby parking buildings.
To avoid obstructing other residents, creating a safety hazard, and/or being towed, you should only ever park in your own carpark (or a carpark where you have the express permission from the lawful occupier to park).
Vehicles left on common property
If access to or from your lot is obstructed by a vehicle parking illegally on common property, contact the Building Manager, or if after hours, Security. Such illegally parked vehicles can be moved to a safe place (typically, the impound lot of Anytime Towing, for collection by the owner for a fee) under section 53C of the Owners Corporation Act. To ensure compliance with the law, residents should not directly authorise a tow of vehicles on common property.
Vehicles left on your lot
If a vehicle is left in your lawful possession because the owner parks it on your lot, you may have a right to have it moved. Anytime Towing specialises in removing illegally parked vehicles from private lots, by towing them back to their impound lot and then collecting the towing and storage fees from the owner when they collect it. As a person in lawful possession of the vehicle, you would need to authorise the tow, and take responsibility for it as a matter between you, Anytime Towing, and the driver of the vehicle. While the Owners Corporation has allowed Anytime Towing signs to be erected in the carpark to provide information to any illegal parkers, the Owners Corporation is not involved in tows from private lots. The Owners Corporation does not provide legal advice to residents in relation to towing (and nothing on this website should be construed as such) - you should seek your own legal advice from a qualified lawyer if you are unsure about the legality of authorising a tow in your particular circumstance.
If you’ve parked illegally and been towed
If your vehicle has been removed by Anytime Towing, you can directly contact Anytime Towing to find out how to get your vehicle back. A fee will apply to cover their charge for towing and storing the vehicle.
Rules related to the carpark
The following special rule applies.
A Member must not, and must ensure that the Occupier of a Member’s Lot does not:
- drive or operate any motor vehicle on any internal road surface in excess of 10kph.
- park or leave a vehicle on the Common Property so as to obstruct a driveway or entrance to a Lot or in any place other than in a parking area specified for such purpose by the Body Corporate.
- permit bicycling, roller blading, skate boarding, roller skating, or ball games in the car parking areas, driveways, or access pathways or any part of the Common Property.
- use any car park space otherwise than for the purpose of parking any motor vehicle or motor cycle or boat or bicycle therein and then in such manner as may be fair and reasonable or permit any mechanical repairs, except of an emergency nature, be performed on any vehicle so parked.
- park, either for short or long term time periods, any Occupier’s vehicle in any car park space, driveway, except in the space or spaces as delineated on title as belonging to each individual Lot.
- interfere with the operation, function or control of the electronic vehicular gates.
- obstruct any easement giving access to any Lots or to Common Property for any purpose other than the reasonable ingress to and egress from an Occupier’s respective Lot.
- wash any vehicle in any area or car park space or any Common Property whatsoever.
- allow any build up or discharge of oil or any other fluids from any parked vehicle and ensure that all vehicle parking surfaces are cleaned and any oil, grease and fluids of any kind are removed immediately upon notice of same or notification of build up by the Body Corporate.
- allow any visitor, invitee or guest to park in any area of the car park.
In addition, the following Model Rule applies in relation to storing flammable material:
- Except with the approval in writing of the owners corporation, an owner or occupier of a lot must not use or store on the lot or on the common property any flammable chemical, liquid or gas or other flammable material.
- This rule does not apply to—
- (a) chemicals, liquids, gases or other material used or intended to be used for domestic purposes; or
- (b) any chemical, liquid, gas or other material in a fuel tank of a motor vehicle or internal combustion engine.
